Mechanico | Master Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you ("User," "Shop," or "Fleet Owner") and Auto Mechanico OU ("Company," "we," or "us"). By clicking "I Accept," signing up to and or downloading our Mobile App, or using our Sites (mechanico.io), you confirm you have read and agreed to these terms, including our Privacy Policy.

2. Description of Services

Mechanico provides a dual-interface platform:

  • The Marketplace: Allowing motorists and fleets to discover, obtain quotes for, maintenance history and book automotive repairs.
  • The Workshop Suite: A SaaS management tool for workshops to handle bookings, parts inventory, diagnostics, and customer communications.
Important: Mechanico is a facilitator. The contract for any automotive repair or maintenance service is strictly between the Motorist/Fleet and the Workshop.

3. Technical Data & Estimating

To assist in transparency, Mechanico integrates third-party technical data and labor guides.

For Estimating Only: Quotes generated using integrated labor guides are estimates. They are provided "as-is" for informational purposes.

Professional Judgment: Workshops must use their professional expertise to verify that the suggested repair procedure and labor time are appropriate for the specific vehicle.

Liability Limitation: Mechanico is not liable for mechanical failures, engine damage, or safety issues resulting from inaccuracies in third-party technical manuals or diagrams.

4. Payment Terms (Hybrid Model)

Mechanico offers flexibility in how services are settled.

4.1 On-Platform Payments (Stripe)

If you pay via Mechanico, transactions are processed via Stripe (a PCI/DSS compliant provider). By using this feature, you agree to the Stripe Connected Account Agreement. Mechanico acts as an agent for the limited purpose of facilitating the collection of funds.

4.2 Off-Platform (Direct) Payments

Motorists may choose to pay the Workshop directly (Cash/POS) at the shop.

Disclaimer: Mechanico is not responsible for verifying or refunding off-platform payments. Any disputes regarding cash/direct payments must be resolved between the Motorist and the Workshop without Mechanico’s involvement.

4.3 Non-Circumvention

Workshops agree not to encourage Motorists to bypass the Mechanico platform to avoid platform fees. Repeated "leakage" of leads may result in account termination.

5. Workshop Subscriptions & Termination

5.1 Subscription Billing

Workshop tools are provided on a recurring subscription basis. Fees are non-refundable.

5.2 Termination & Fees

Notice: Annual subscriptions require a 30-day written notice prior to the renewal date for cancellation. Early Termination Fee: If a Workshop terminates an annual agreement early, a fee equal to the remaining balance of the current subscription period shall become immediately due and payable.

5.3 Data Retrieval Period

Upon termination (unless due to breach), Mechanico provides a 30-day Retrieval Period. You may access the platform solely to export your "Customer Data" (service history, client lists) in industry-standard formats.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF MECHANICO TO YOU FOR ALL CLAIMS IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO MECHANICO IN THE 12 MONTHS PRIOR TO THE CLAIM; OR (B) $100. We are not liable for indirect, incidental, or consequential damages, including loss of profit or damage to property resulting from repairs performed by third-party workshops.

7. Privacy & Data Use

  • Vehicle Data: You grant us a license to use vehicle-specific data (VIN, repair history) to provide services and improve our diagnostic tools.
  • Confidentiality: We will not sell Workshop-specific customer lists to third-party competitors.

8. Dispute Resolution (Arbitration Notice)

Except for small claims or intellectual property theft, all disputes will be resolved by binding, individual arbitration. YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

9. Communication Consent

By using the service, you consent to receive operational and promotional SMS, calls, and emails. You can opt-out of marketing at any time by texting "STOP” on mobile or unsubscribe via mail ad. but you acknowledge that opting out of operational messages (e.g., “Car repair status such as communication during repair, inprogress, ready for pick up etc.. Your car is ready") may impact your use of the service.
